These terms apply to Mrtn, the macOS app, its online service and this website, while Mrtn is in its pilot. They are short on purpose. If your organisation has signed a separate agreement with us, that agreement takes precedence.
Who provides Mrtn
Mrtn is provided by StarApps BV ("we", "us"), Dok Noord 4D/101, 9000 Gent, Belgium, enterprise number BE 0758.840.403. The customer is the organisation that uses Mrtn and invites its people ("you"). Questions go to hello@mrtn.tech.
The pilot
Mrtn is new and still changing. During the pilot it is provided as is and as available: features can change or go away, and we don't promise that it will always be available, free of errors or fit for a particular purpose. We fix problems as quickly as we reasonably can. We will give you notice before the pilot ends.
Coaching, summaries, follow-ups and scorecards are generated automatically and can be wrong or incomplete. Read them before you rely on them, and before anything is sent or changed in your tools.
Accounts
Your organisation's admins decide who is invited and what role they have, and are responsible for the accounts they create. Keep your sign-in to yourself. Tell us right away if you think someone else has used your account.
Recording calls
Recording a conversation is regulated, and the rules differ from country to country. As the customer, you are responsible for informing the people on your calls that the call is recorded and transcribed, and for getting their consent where the law requires it. Mrtn helps, with reminders in the app and in your playbooks, but it does not take that responsibility from you.
The same goes for your own people: if you use Mrtn's scorecards or call results to review employees, inform them as your local law requires, including through works councils where they exist.
Acceptable use
Use Mrtn lawfully and for its purpose. In particular, don't:
- record anyone without the notice or consent the law requires;
- use Mrtn to harass, deceive or unlawfully monitor anyone;
- try to get around its limits or security, reach other organisations' data, or overload the service;
- copy, resell or reverse engineer Mrtn, except where the law allows it;
- use it to build a competing product.
We may suspend an account that breaks these terms or puts the service or other customers at risk. Unless it's urgent, we contact you first.
Your data
What you put into Mrtn and what it produces from your calls is yours. You allow us to process it only to provide the service to you. For call data we act as your processor, under our data processing agreement, which describes what we do with it, the sub-processors we use and how we keep it safe. Our privacy policy explains the rest.
You can ask for an export of your organisation's data at any time, and for its deletion when you stop using Mrtn.
Fees
The fees and usage included in the pilot are the ones agreed with you in writing. When your organisation's agreed usage runs out, Mrtn stops starting new calls until it is topped up.
Liability
As far as the law allows, we are not liable for indirect damage, such as lost profits, lost business or lost data, and our total liability is limited to the fees you paid us for Mrtn in the twelve months before the claim. None of this limits liability for fraud, intentional misconduct or anything else the law doesn't allow us to limit.
Ending
You can stop using Mrtn at any time. Either of us can end the pilot with notice, or right away if the other seriously breaks these terms. When it ends, we delete your organisation's data after giving you the chance to export it, unless the law requires us to keep part of it.
Changes
We may update these terms. We update the date at the top and tell you before a change that matters applies. If you don't agree, you can stop using Mrtn.
Law
These terms are governed by Belgian law, and the courts of Ghent (Gent) have exclusive jurisdiction over any dispute about them.
